It's perfectly legal for them to sell Inkscape in this way. However, if a buyer is smart, he'll do research on the program before deciding to "buy" it, and he'll find the official website with download instructions. If a buyer is not smart, there's little that can be done to prevent him from wasting his money.

I believe the license states they have to distribute the software with the sourcecode. So if they're not doing that then they are doing something wrong

Actually the GPL just says the source must be made available on request. You don't have to distribute the source code with the binaries up front unless you want to. However, many people are under the mistaken impression that as long as the code is available from any source, that counts. The GPL specifically states that the distributor of the program must make the code available (because you can't guarantee the other sources will stay around). I am sure these guys aren't doing that, but I doubt anyone will make an issue of it.
